What changed
Order in Council 369/2025 amended the Technology Innovation and Emissions Reduction (TIER) Regulation to raise the per-tonne compliance payment ceiling from $80 to $95 effective January 1, 2026. The excess emissions charge — what you pay when you exceed your facility benchmark — increases by $15/tonne year-over-year.
Who is affected
All designated industrial facilities under TIER in Alberta: oil sands operations, upgraders, refineries, cement plants, chemical manufacturers, and electricity generators above the 100,000 tonne CO₂e threshold. If your facility files an annual TIER compliance report, this applies to you.
Dollar impact
A facility with 50,000 tonnes of excess emissions above benchmark now faces $4.75M in compliance payments vs. $4.0M under the previous ceiling — an increase of $750,000 for the same emissions position. Facilities carrying TIER credits or performance credits from prior years should model the new ceiling into their 2026 offset strategy before Q1 closes.
